WEEK 24 - DAY 5

Article in today's ThisWeek UA, "Supreme court to consider city's case; petitioners respond to suit"

According to the Assistant City Attorney, the City Attorney has the authority to spend up to $15,000 on the special counsel.  That doesn't include city employee time that's being spent on this, however.  It would be interesting to see a comprehensive tally of all of your money being allocated to this effort.

WEEK 24 - DAY 4

Article in yesterday's UA News, "UA leaders take Issue 52 to Supreme Court.


The Assistant City Attorney is quoted as saying, "should the issue pass and the city be forced to terminate the contract with Inland ..."

This is confusing. 

Remember, the ordinance to enter into a contract was passed as an emergency, and the City has been claiming for 8 months now that they have a contract so the vote's outcome on November 4 has NO IMPACT on the necessity to terminate the contract. 

What has changed? 

Why doesn't the city want us to even vote on this?

What aren't we being told?

And he continues, "... [this] would leave the city at risk for, potentially, millions of dollars in contract damage payments."

Again, this is confusing.  Damages due a contractor are a function of the potential lost profit, not the entire contract value.  See "Restoring Old Service" for a discussion of the first year transition cost.


Also in yesterday's UA News, a Guest Column, "City's challenge presents inaccurate 'facts.'" 

Hmmm ... why is the City misrepresenting the facts in its communications to us?

WEEK 24 - DAY 2

The Ohio Supreme Court has accepted Mike's "Motion to Intervene," so he will be defending the City's action along side with the Franklin County Board of Elections.

The Board has yet to file its answer to the City's complaint ... this needs to be done by Thursday at the latest.

At that point, the City has three days to file a brief, after which point Mike and the Board have three days to file their briefs. 

Then, the City files an answer to Mike's and the Board's briefs.

And, then the Ohio Supreme Court decides.

ALSO, we got the City's "spreadsheet" showing how it arrived at its $8 million dollar "estimate."

WEEK 24 - DAY 1

Mike Schadek's attorney, Jim Becker, filed with the Ohio Supreme Court a "Motion to Intervene."  If this were to be approved by the Court, Mike would join the Franklin County Board of Elections in defending against the City's action.
